1Agreement to terms

These Terms of Service (“Terms”) are an agreement between you and JellyPuffs (“JellyPuffs,” “we,” “us” or “our”). They apply to your use of JellyPuffs.com, including all pages, content, features and purchases (the “Site”).

By accessing the Site, creating an account or placing an order, you confirm that you have read and agree to these Terms and to the policies referenced in them. If you do not agree, do not use the Site.

2Age requirement

JellyPuffs sells nicotine and vaping products to adults 21 years of age or older. By using the Site you confirm that you are at least 21 and of legal age to purchase these products where you live.

• We may use third-party age and identity verification before, during or after checkout.
• We may request a valid government-issued photo ID at any time.
• Orders that fail verification will be cancelled and refunded.
• Products must not be purchased for resale to, or use by, anyone under 21.

3Your account

You are responsible for the accuracy of the information you provide, for keeping your password confidential and for all activity under your account. Notify us at support@jellypuffs.com if you believe your account has been accessed without permission.

We may suspend or close accounts that violate these Terms, provide false information or are used for fraudulent activity.

4Products & descriptions

We work to display product information — puff count, battery capacity, e-liquid volume, nicotine strength and flavor — accurately. Manufacturers may change specifications or packaging without notice, and colors may vary by screen. We do not warrant that every description is complete, current or error-free.

Product availability changes daily. Listing a product on the Site does not guarantee it is in stock.

Nicotine is an addictive chemical. Our products are not intended for use by non-smokers, pregnant or breastfeeding women, or persons with health conditions, and JellyPuffs makes no health claims about any product.

5Pricing & payment

• All prices are listed in US dollars and may change without notice.
• Applicable sales and excise taxes are calculated at checkout based on your shipping address.
• If a product is listed at an incorrect price due to an error, we may cancel the order and refund any payment, even after confirmation.
• You authorize us and our payment processors to charge your selected payment method for the full order total.
• Discounts, promotions and codes cannot be combined unless stated, have no cash value and may end at any time.

6Order acceptance

Your order is an offer to buy. An order confirmation email confirms we received it — not that it has been accepted. We may refuse, limit or cancel any order, including for failed age verification, suspected fraud, quantity limits, shipping restrictions or pricing errors. If we cancel an order after payment, we will refund the amount charged.

7Shipping & restrictions

We ship within the United States only, to locations where the sale and delivery of vaping products is legal. State and local laws change; we may be unable to ship certain products to certain addresses, and a signature from an adult 21+ may be required on delivery.

Title and risk of loss pass to you when the carrier delivers your order. Delivery estimates are not guaranteed. See our Shipping Policy for rates, processing times and carriers.

8Returns & refunds

Refunds are available for defective items, such as leaking or non-working devices, reported with video proof within 48 hours after tracking shows delivery. Flavor-related issues are not refundable. Full details are in our Return & Refund Policy, which forms part of these Terms.

9Cash back rewards

Eligible orders earn cash back as JellyPuffs store credit, as described on our Cash Back Rewards page. Store credit has no cash value, is non-transferable, can be used only on JellyPuffs.com and may be reversed for refunded, cancelled or fraudulent orders. We may change or end the program at any time; balances already earned remain available to spend.

10Acceptable use

You agree not to:

• Use the Site for any unlawful purpose or in violation of any law.
• Provide false information, including false age or identity information.
• Purchase products for resale without our written permission.
• Interfere with the Site’s security or operation, or introduce malware.
• Scrape, copy or collect Site content or data by automated means.
• Abuse promotions, reward programs, refunds or chargebacks.

11Intellectual property

All Site content — including the JellyPuffs name and logo, text, graphics, images and design — belongs to JellyPuffs or its licensors and is protected by intellectual property laws. You may not copy, reproduce or distribute it without our written permission. Third-party brand names and trademarks belong to their respective owners.

12Reviews & submissions

If you submit a review, comment or other content, you grant JellyPuffs a non-exclusive, royalty-free, worldwide license to use, display and reproduce it in connection with the Site and our marketing. Submissions must be honest, lawful and your own. We may edit or remove any submission at our discretion.

13Third-party links & services

The Site may link to or use third-party services, such as payment processors, carriers and verification providers. We are not responsible for third-party content, policies or practices, and your use of those services is subject to their own terms.

14Disclaimer of warranties

THE SITE AND ALL PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” TO THE FULLEST EXTENT PERMITTED BY LAW, JELLYPUFFS DISCLAIMS ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE AND NON-INFRINGEMENT. ANY MANUFACTURER WARRANTY IS PROVIDED BY THE MANUFACTURER, NOT BY JELLYPUFFS.

15Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, JELLYPUFFS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR PUNITIVE DAMAGES ARISING FROM YOUR USE OF THE SITE OR ANY PRODUCT. OUR TOTAL LIABILITY FOR ANY CLAIM WILL NOT EXCEED THE AMOUNT YOU PAID FOR THE ORDER GIVING RISE TO THE CLAIM.

You are responsible for using products according to the manufacturer’s instructions, including safe charging and storage of devices with lithium-ion batteries.

16Indemnification

You agree to indemnify and hold harmless JellyPuffs and its owners, employees and partners from any claims, losses or expenses, including reasonable attorneys’ fees, arising from your breach of these Terms, your misuse of any product or your violation of any law or third-party right.

17Governing law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law rules. Any dispute will be resolved in the state or federal courts located in Harris County, Texas, and you consent to their jurisdiction. If any provision of these Terms is found unenforceable, the rest remain in effect.

18Changes to these terms

We may update these Terms at any time by posting the revised version on this page with a new “Last updated” date. The version in effect when you place an order applies to that order. Continued use of the Site after changes means you accept the updated Terms.
